Kenya court jails Delamere kin for eight months

Judge Apondi had initially reduced Cholmondeley’s murder charge and convicted him for manslaughter.
"The discretion of sentence lies with the judge but eight months is far below the mark. We will need to put precedents before the court of appeal in our efforts to enhance and correct judgment," said the DPP.
Judge Apondi had initially reduced Cholmondeley’s murder charge and convicted him for manslaughter, which carries a maximum sentence of life imprisonment and no minimum.
He found that Cholmondeley shot and killed Mr Njoya three years ago, but spared him death by hanging because a murder charge could not be sustained.
A murder conviction carries a mandatory death sentence.
Mr Justice Apondi relied on the evidence of Mr Carl Tundo, who was with Cholmondeley on the fateful day, to rule that the accused shot and killed Mr Njoya.
He found that the accused did not have malice aforethought (intention to kill) when he shot Mr Njoya at his Soysambu ranch on May 10, 2006.

High Court judge Muga Apondi has no moral being a judge or a magistrate.He even acquited a woman who killed her husband.The chief justice/president should form a commission to investigate this judge.He seems to be corrupt of ideas at the expense of Kenyans life.

Firstly could we establish that the new name for 'settlers' is immigrants. Now if an immigrant, killed even a tax payer's dog, you might get 8 months but sure as anything else you need to go back to your uncivilised country and learn to respect animal rights, or where killing animals is OK. If these people protect their PETS like that, please tell me there are some proper law makers in Kenya who put higher value on HUMAN LIFE than that.

Eight months is being very lenient for a man who has killed.He should have been given a life sentence so that he can truly reflect on what he did. Just because he offered his car and took the injured to hospital does not mean we should forget the fact that it was he who pulled the trigger ending another mans life. This just comes to show what a big joke the judicial system in kenya is.
