Raila urged to fund Ringera job advert

The Prime Minister should use his powers to fund the Kenya Anti Corruption Commission Advisory Board, an MP has said.

Dr Bonny Khalwale said on Thursday that Mr Raila Odinga should fund the advisory board so that they can advertise the posts of director and assistants directors of the commission.

“The Prime Minister enjoys powers of coordination and supervision of all government ministries and functions and he must use such powers to ensure money is availed to the KACC Advisory Board for advertisement of the vacant posts,” he said.

On Tuesday, the embattled KACC director Justice Aaron Ringera indicated, according to sources, that the commission will not pay for an advertisement inviting applicants for the posts of KACC director and two assistant directors.

The KACC director must give the nod for the commission to pay for the advertisement.

Dr Khalwale maintained that the decision of the National Assembly is binding and added that it should be respected.

“If the director or anyone else is aggrieved by the decision of the National Assembly, then they are free to seek legal redress to challenge it,” he said at a press briefing.

Justice Ringera has refused to relinquish his post despite Parliament declaring last week his reappointment by President Kibaki for a second five year term illegal.

“Only the courts can declare the President’s move illegal and annul the reappointment,” he is said to have told members of the board during a charged meeting at the commission’s headquarters at Integrity Centre, Nairobi on Tuesday.

Parliament, Dr Khalwale asserted, was not offering an option but rather made a decision that is binding to the executive and the parties concerned.

He stated that the House ruled that the laid down procedure for the reappointment of the director and his assistants was not followed.

“Parliament annulled their appointments and the advisory board is free to conduct the process properly and recommend persons to fill the positions,” the legislator said.

The Ikolomani MP further said that he will withdraw a case filed in court challenging the re appointment of Justice Ringera and the two assistants Dr Smokin Wanjala and Mrs Fatuma Sichale.

He noted that the court suit has been overtaken by events as Parliament passed a ruling on the same issue.
