The others, he said in his letter, should be tried by a local tribunal which the government has to establish in line with internationally-accepted standards, which require that the cases are cushioned from interference by the President’s and the Attorney-General’s powers to pardon suspects or terminate cases.

During his visit to Kenya last week, Mr Annan also stated that both the Hague trials and the local tribunal have to be adopted to ensure justice for the victims.

The government is now exploring the possibility of side-stepping Parliament in the formation of the local tribunal. Sources said a Special Division of the High Court could be set up to try the executors of the chaos.

Mr Moreno-Ocampo’s November trip could signal a surprise to key politicians who opposed the local tribunal Bills in the hope that The Hague would take a longer time to start investigating the Kenyan case.

The ICC prosecutor is expected to either seek the government’s help in arresting the suspects or allowing ICC investigators to arrest them at an appropriate time.

    On my opinion Mr.Ocampo's coming is on holiday.And what expect to hear from him is when the western countries will compensate Africa the environment they have heavily degraded our resources they have stolen since independence.

    Alleged stealing of an election or actual rigging does not constitute genocide and crimes against humanity according to the Rome statute. So this blah blah of taking Kibaki to the hague on account of stolen election does not move Ocampo!!!

    Let the media shed off hypocracy and report facts. Kibaki and Raila are PEV PRIME SUSPECTS. Kibaki was accused of stealing an election. Raila was commander-in-chief of mass action that led to slaughter of innocent Kenyans. How can suspects decide how their lieutenants in crime should be tried at ICC? If Ocampo’ll not indict Kibaki and Raila, he’s just fooling us about justice. Kenyans fought due to actions of Kibaki and Raila – greed for power.

    I have been watching Mutulas moves lately and I must confess I am pleasantly suprised. Looks like he has rediscovered himself before Moi and politics! Now 'like Ceasars wife' he is puting himself beyond reproach by using the press to communicate his actions publicly and expeditiously. For once, I am proud to confess Mutula is my MP and at this rate he might have my vote for the first time, next time, and my support! Mutula pass it to them immediatly and let it be known. If they want to keep it for a year its their baby!
