Courts fail to account for millions collected

The Controller and Auditor-General has unearthed financial irregularities running into millions of shillings at several law courts, the Nation has learnt.

The latest audit report seen on Sunday indicates that a number of law courts countrywide cannot account for millions collected in form of fines, court fees and deposits.

At the Bondo Law Courts, the report shows that Sh7,044,689 collected between December 2004 and June 2008 had not been surrendered or accounted for as at June 30, 2008.

“Further, a cash survey conducted at the law courts on August 19, 2008, revealed that the amount... included a cash deficit and irregular expenditure at source of Sh3,871,239.35 and Sh1,006,677, respectively,” the report adds.

Partly paid

The audit also shows that revenue totalling Sh5,817,183.05 in respect of fines and forfeitures collected at Busia Law Courts was not banked intact, but was irregularly expended or held as partly paid vouchers and I Owe Yous (IOUs).

“Out of the total revenue spent at source, Sh80,130 related to IOUs which had not been recovered as at June 30, 2008.” At Kitale Law Courts, the report shows that more than Sh5.6 million has not been accounted for since 2007.

At Bungoma Law Courts, queries have been expressed over revenue collections totalling Sh1,825,410.50 in respect of court fees, fines and deposits, which were not banked intact as required by regulations, but were instead held irregularly as partly paid vouchers, IOUs and Refer to Drawer (RD) cheques.

Receipt books

Examination of financial records maintained at the Naivasha Law Courts revealed that three receipt books were used to collect revenue totalling Sh682,900 between January and February 2008.

However, the revenue collected had not been accounted for as at June 30, 2008. At the Coast, audit queries have also been raised over revenue receipts amounting to Sh567,507.60 which had not been surrendered as at June 30, 2007, at the Voi Law Courts.

    @shilavula just abit of refresshin learned freinds dont do accounts at the courts they only preside over cases and represent clients. get your facts write dimwit

    Amazing thing is it took soo long.Aren't there yearly audits?If not, they sh'd be implemented.This would have limited amount lost and highlighted this theft 4yrs ago.
