After gathering enough evidence, he will go to the Pre-Trial Chamber to request summons or warrant of arrest.

"This would be the moment that the names of persons who have to face justice will be revealed, not before."

The Summons to Appear can only be issued if the perpetrators of the violence will not seek to evade justice.

"If the Prosecutor considers the persons will not try to escape justice, that they will not destroy evidence or threaten witnesses, he can propose that the Pre-Trial Chamber issue a Summons to Appear, under which the person appears voluntarily before the Court," he said. He gave the example of Darfur rebel leader Abu Garda, who appeared voluntarily.

Mr Ocmapo expressed confidence that Kenya will arrest the post election violence suspects if called upon because it "is a well organised state."

Mr Ocampo, who jetted into the country on Thursday to meet President Kibaki and Prime Minister Raila Odinga over the post poll violence, left for South Africa after the media briefing.

His meeting with the two principals on Thursday yielded little, after the two leaders declined to hand over the case to the ICC. This left the Prosecutor will no option but to take over the case.

However, the government agreed to cooperate fully with the ICC in case it takes possession of the case.

The chaos that followed a disputed presidential election in 2007 left at least 1,300 and another 650,000 displaced from their homes.

The two months of violence ended after former United Nations secretary general Kofi Anann brokered a peace deal that saw Mr Kibaki and Mr Odinga agree to form a power-sharing coalition government.

    Reality has now dawned on those who thought that these murders were committed by just one community. Now they are trying to force everyone to think Kenyan. Bloggers and reporters from one section of the country kept on calling one community as murderers forgetting that their own were also in the thick of things too. It's about time PNU and ODM paid their dues to society. And even if Ocampo doesn't get these goons they will be marked men just like Pollack who is awaiting extradition to the US after being on the run for twenty years.

    Nation readers,Ocampo was unwinding when he visited our famous wildlife.Thats means breaking the ice for them to relax so as the PEV will not have hard times answering or defending themselves in Hague.So nation readers again wait and relax for Mr.Ocampo to do what all kenyans think is imposible and tedious.

    Why too much hype about kenya? Crimes against humanities are being committed every day.In Iraq,pakistan and Afghanistan hardly a day passes by without roadside bombs killing and maiming many.The US DRONES are killing innocent people in Afghaniatan, pakistan and somalia every too often.How about Russia's invasion of Georgia? how many were killed? Did i mention Nigeria where there have been religious and ethnic violence resulting in many deaths? Our leaders need to man up and tell the likes of Annan that we will take care of ourselves.We know better whats ailing Kenya.

    Go get them Ocampo !!!! 2012 Elections will have different players. There is no way the suspects will go down alone....especially ODM suspects. They will spill the beans. Am lovin it !!!

    Note to the Nation online editors. You should allow free speech. I have noticed that comments that are not favorable to one politician in Kenya are not published. How can we call for protection of freedom of press if the press curtails freedom of speech?
