Lady Justice Florence Muchemi was later posted to Bungoma and was gazetted to hear the petition but Mr Wetangula was at it again after he filed an application seeking for the dismissal of the petition saying the Interim Independent Electoral Commission (IIEC) had no mandate to take over the petition but it was dismissed and a hearing date set.

Mr Wetangula further filed another application before Lady Justice Muchemi saying the process server was not an authorised person since he did not have a valid licence.

The ruling is slated for November 18.

It is a similar application that Justice Shah would be arguing at the Court of Appeal when the case comes up for hearing. Mr Waluke through his lawyer Alex Masika said he would be opposing the application

This is how kenyans should spot selfish "leaders" who would do anything in their capacity in their own good.Wetangula we are watching you and waiting you at the end, that is the ballot box even if you change your party and soften your stands we will make sure we spot you out, just as martha karua is trying to reform but we cant trust such leaders.
