Convict laughs at verdict

A man shocked a Garsen court in Tana Delta District when he laughed loudly after he was handed a life prison term for rape of a disabled man.
Resident magistrate Justus Mulei Kituku sentenced Safari Kai Ndundi to life imprisonment on two accounts of raping and infecting his victim with HIV.
Ndundi committed the offence on October 30, 2009, in Garsen, the court was told.
Mr Kituku said the accused was saved by police officers as the public was about to lynch him on catching him in the act.
HIV-positive
“The accused deliberately and willingly committed the crime well aware that he would transmit a life-threatening disease to the victim,” observed the magistrate.
He said the accused knew he had been HIV-positive since 1987.
“The act was cruel and beastly as it exposed the victim to a life-threatening disease,” Mr Kituku said.
“The court finds the accused a threat to society and should be kept away for life,” he added.
