Couple loses fight over Saitoti son

The dispute over the parentage of former Internal Security Minister George Saitoti’s son has been settled.

The matter was laid to rest on Thursday after a Nakuru couple who laid claim to Zachary Musengi Saitoti agreed never to make such claims again.

This was after investigations by the Director of Public Prosecutions established that Zachary was not the son of Mr Sebastian Maina Ngunju.

In a consent order entered and signed at the Milimani Law Court on Thursday, Mr Ngunju and his wife, Elizabeth, agreed never to file any suit claiming Zachary is their son.

Stole their son

“An order of prohibition is issued to permanently bar the couple or their family members from contacting Mr Musengi or Mrs Margaret Saitoti directly or indirectly in respect of the allegations that they are the parents of Zachary,” read the consent.

The couple agreed to withdraw a case they filed in a Nakuru court seeking to institute private prosecution against Mrs Saitoti over allegations that she stole their son.

The Ngunjus also agreed not to file any other criminal case against Mrs Saitoti in any other subordinate court.

Mr Ngunju and his wife last year filed a suit in a Nakuru court claiming that Zachary was their third-born and asked the magistrate for leave to prosecute Mrs Saitoti for keeping his son allegedly stolen from their Subukia home 24 years ago.

They had claimed that Zachary was born Stephen Wachira, and that he was kidnapped three days to his third birthday by a woman who was later arrested, charged and acquitted by a Nairobi court.

They claimed they had been unable to pursue the matter after receiving threats over the issue.

However, Mrs Saitoti and Zachary filed a petition at the High Court, claiming the couple was fraudsters and pranksters out to extort money from them.
