Justice Isaac Lenaola issued the orders following an urgent application by Prof Saitoti’s widow Margaret and her son Zachary Musengi.

“Having read the application of Mrs Saitoti and her son, am satisfied that the orders sought in the circumstances are justifiable and direct that the case filed by Sebastian Maina Ngunju seeking leave to file criminal case against Mrs Saitoti should not proceed,” ruled Justice Lenaola.

Mrs Saitoti and her son filed the application claiming that the suit by the Subukia couple is an ulterior motive by fraudsters to extort money from the family and divert public attention from the ongoing commission of inquiry into the helicopter crash that killed Prof Saitoti.
