The Judicial Service Commission (JSC) has formed a sub-committee to probe into claims that Deputy Chief Justice Nancy Baraza assaulted a security guard in a shopping mall on new year eve.
The sub-committee is expected to present its findings to the JSC by Friday 2.30pm.
It will "receive and interrogate" all evidence on the alleged incident, including a statement from the victim Rebecca Kerubo, footage from CCTV cameras that captured the incident at the shopping mall and a police file opened for the incident.
These were the resolutions of an emergency session convened on Monday by Chief Justice Willy Mutunga to investigate the conduct of his deputy.
Lady Justice Baraza is alleged to have pointed a gun at a security guard after refusing to be frisked at the Village Market shopping mall. She also allegedly pinched the guard’s nose during the incident.
"The Judicial Service Committee is going to handle this matter with fairness. Once the sub-committee will give us their recommendation, we will make a decision and inform the public," Chief Justice Mutunga told journalists at the end of the JSC meeting.
Justice Mutunga had on Thursday last week called an emergency session of the JSC to discuss the matter. (READ: Mutunga calls JSC over Baraza)
The critical part of the JSC inquiry will be the questioning of Lady Justice Baraza against her written statement and review of CCTV footage at the shopping mall. (READ: Moment of truth for the deputy CJ)

Why are people making judgements even without listening to the two sides of the story? We might set a very bad precedent. The guards should be trained on how to handle difficult customers without confronting them since this can also endanger their lives. The management should device a quick response mechanism to handle this kind of circumstance.

In more advanced democracies even a domestic scandal is enough to force one to resign from Office But not so in Africa .

This is a Police case. Simple, gather evidence and move to court and charge her and her subservient driver. Then let a judge rule. In the meantime, she should vacate the august office, she has brought shame and embarrassment to the office. That job is much more than doing the rounds with female companions tasting prison meals.

Someone allegedly asaults another in a market and our answer to that is to form a committee? Already we have so many committees we may have to form a committee just to keep track of other committees! In the meantime in the land of committees everything is in a stanstill!
