Former President Daniel arap Moi is still locked in a fight with a one-time trusted friend over ownership of prime land at the Coast.

Mr Moi and Mr Rashid Sajjad, a former Kanu nominated MP, have not agreed on whether the dispute should go to full trial or be settled out of court.

The dispute involves a 0.5 hectare beach plot in Nyali which was valued at Sh7.5 million in 1996. It should be worth hundreds of millions of shillings at current rates.

The disclosure was made on Tuesday during mention of the case in which Mr Sajjad has moved to court to stop his arrest and prosecution over the piece of land allegedly sold to him by the former president.

The Attorney-General, Director of Public Prosecutions, Commissioner of Police, Director Criminal Investigations Department have been named as respondents alongside Mr Moi. The State was not represented hence the court could not issue any orders.

Lady Justice Mary Kasango fixed the case for mention on March 7 when the court is expected to give directions on the matter.

In their application, Mr Sajjad and a Mr Mohamed Saleh Bawazir say that sometime in 1996, they met the former president at State House in Nairobi upon which he offered to sell the land to them at Sh7.5 million.

Present when the offer was made was Mr Joshua Kulei, then a close confidant of the former president.

In papers filed in court, Mr Sajjad said they agreed to purchase the property in the name of their company then known as M.S.Bawazir & Company.

Mr Sajjad says that in January last year he got information that police were looking for him on matters touching on the sale transaction.
