President Kibaki has declined to assent to a proposed law that would have limited the number of Cabinet ministers to 24.

The Head of State has recommended that the Bill be deferred until the new Constitution is in place, saying it would be an exercise in futility to put it into law under the current circumstances.

Requirements

“At the moment, it is not possible to ascertain the conformity of the content of the Bill with the requirements of the new Constitution as these are yet to be settled,” he said in a memorandum to Parliament.

The country’s current Constitution says that “there shall be such offices of Minister of the Government of Kenya as may be established by Parliament or, subject to any provisions made by Parliament, by the President”.
