Opening investigations

During the November 5 discussions, Mr Moreno-Ocampo informed the two principals the crimes committed met the Rome Statute of the ICC  threshold of opening an investigation.

They discussed the fact that the ICC proceedings could be held in Kenya, The Hague or any other contracting state.

And to protect witnesses, the PM has recommended tightening the Witness Protection Act. To this end, the ministry of Justice and Constitutional Affairs will come up with amendments.

Imenti Central MP Gitobu Imanyara had sought to know the steps taken to protect would-be witnesses so that “they are all safe and not subjected to disappearances.”

Mr Danson Mungatana (Garsen) said there was a genuine fear among Kenyans that the government was refusing to formally refer suspects to The Hague because it was protecting members of its Cabinet.

    Ocampo should take all these politicians, lock them up wherever and kenyans to elect new young leaders.

    Wekechris and otienoz you so homophobic that everything is Raila Vs Kibaki and Mt. kenya vs the rest. Justice must be adhered to and Raila has not exonerated himself or Kibaki. I admire his position on PEV. Otienoz Kibera has been raila's constituency since 92. We have poor people in Othaya and sqatters as well, leave alone Mungiki. When was pres. elected to represent Kibera! Mass Protest is a human right - it happens in DC, London, Hague, paris and even property is destroyed - watch G8 or WB meetings, How many are usually killed?

    What are they debating when the PM is in the headlines of this paper reassuring the violence perpetrators. They know you can't trust a politician and after all they should know. How can Raila tell leaders of the violence not to worry...nothing will happen. Business as usual, kenyans have a short term memory. I hope we can learn that we have been tricked into hating the kikuyu by people in bed with kikuyu leaders.

    Hon Raila, come 2012 you will be the official opposition leader in parliament. make sure this position is entrenched in the constitution. You cannot work as a team with people and after you get somewhere you mistreat them. this is not what really men do. such like situations make me admire mt kenya pple.
