Bid to stop case on Uhuru, Ruto candidacy

A court has been asked to stop a case questioning the suitability of Mr Uhuru Kenyatta and Mr William Ruto to contest the presidency.

Mr Patrick Njuguna and Mr Charles Omanga said by striking out Mr Kenyatta, Mr Ruto, Prime Minister Raila Odinga, Vice President Kalonzo Musyoka and Deputy Prime Minister Musalia Mudavadi, the petition cannot adequately deal with the leadership and integrity issue.

“The thrust of the petition is to deal with the question of the integrity of the five leading contenders for the presidency. Proceeding with the case will prejudice Mr Kenyatta and Mr Ruto as the outcome will directly affect them,” said the petitioners.

They said it would appear to be discriminatory if the petition proceeded unless Mr Odinga, Mr Kalonzo and Mr Mudavadi are enjoined.

The petition was filed in January after the confirmation of charges against Mr Kenyatta and Mr Ruto at the International Criminal Court by civil society activists and internally displaced persons.

They want the candidature of the two declared a violation to the Constitution and would perpetuate impunity.

The petition, however, took a new twist when Mr Njuguna and Mr Omanga amended it to include Mr Odinga, Mr Musyoka and Mr Mudavadi, citing allegations of fraud, corruption, abuse of office, nepotism and land grabbing.

Justice Lenaola set the hearing for November 23.
