Court told Miguna’s suspension can’t be lifted

The suspension of Prime Minister Raila Odinga’s adviser on coalition affairs cannot be lifted, a court heard on Tuesday.

Permanent secretary Mohammed Isahakia told High Court judge John Mwera that the decision to suspend Mr Miguna Miguna and withdraw his salary could not be reversed because it had already been implemented.

Dr Isahakia said Mr Miguna was not entitled to a salary because he was suspended and not interdicted. However, the permanent secretary said he still enjoys house allowance and medical benefits.

Mr Miguna sued Dr Isahakia and the AG after he was suspended as the PM’s advisor on August 4.

Reinstate salary

He is asking the court to compel Dr Isahakia to reinstate his salary, allowances and benefits.

He also wants the court to lift the suspension. Mr Justice Mwera directed the parties to appear before him on September 22.

At the same time, Mr Miguna has accused Dr Isahakia of refusing to release his personal effects.

Through lawyer Nelson Havi, Mr Miguna told Mr Justice Mwera that Dr Isahakia had refused to let him access his personal belongings, including cheque books, photographs and other vital documents.

But a State counsel acting for Dr Isahakia and the Attorney-General denied that Mr Miguna had been denied his personal effects.

The judge directed Mr Havi and the State counsel to resolve the matter amicably.
