ICC judge to receive views on witness protection

International Criminal Court judge Ekaterina Trendafilova has ordered the Victims and Witness Unit to give its views on the chief prosecutor’s risk assessment of Kenya’s witness protection status.
The submissions are to be filed by June 13 for the William Ruto, Henry Kosgey and Joshua Sang case and June 14 for the Uhuru Kenyatta, Francis Muthaura and Hussein Ali case.
The submissions will include “any proposals for additional or alternative protective measures which might be necessary or appropriate in order to ensure the protection of a given witness”.
Security risk assessment
The unit has also been instructed to submit the observations with respect to any other witnesses for whom redactions will be requested by prosecutor Luis Moreno-Ocampo.
A redacted document has some of its sections blacked out.
“The single judge considers necessary, with a view to enabling her to properly rule on the first application for redactions, that the unit provide its observations on the security risk assessment submitted by the prosecutor,” Judge Trendafilova said.
Mr Moreno-Ocampo, while filing his application requesting redactions on some of his evidence, also provided a security risk assessment he had carried out with respect to each witness on whom he intends to rely for the confirmation hearings.
