Mwau moves to block demos

Kilome MP John Harun Mwau has moved to court to block former Ethics and Governance PS John Githongo from carrying out demonstrations allegedly linking him with drug trafficking.

Mr Mwau told Justice George Odunga that his life is threatened and his businesses will be ground to a halt if the alleged demonstrations are allowed to proceed.

The lawmaker is challenging Mr Githongo to make public any evidence linking him with drug trafficking. (READ: Mwau cleared of drug trade claims)

Mr Justice Odunga heard that Mr Githongo and eight others, among them former Mungiki leader Ndura Waruinge, have hatched a six-month exercise that is likely to cause public unrest.

“The matter raises grave issues, which are a threat to Mr Mwau’s life. Mr Mwau and his businesses are at risk,” lawyer Omwanza Ombati told the court.

Mr Ombati said the intended actions by the former PS and members of a lobby group known as Twaweza Sisi are criminal.

The lawyer told the judge that a communication released by Mr Githongo shows the lobby is planning to spend $1,000,000 (Sh90 million) in the demonstrations in Coast, Western, Central, Nairobi and Rift Valley regions.

The demonstrations, he said, are scheduled to continue up to the General Election.

“Unless this court restrains the defendants (Githongo and 10 others) from calling, soliciting and or inciting the public into riots around the MP’s business properties, he (will) suffer irreparable loss and ultimate damage,” Mr Ombati told the judge.

The judge directed the case be heard January 9 and ordered Mr Ombati to serve all 11 defendants.

Mr Mwau has named Mr Githongo, lawyer Ndung’u Wainaina, Twaweza ni Sisi, Mr Tom Mboya, Mr Waruinge, Mr Michael Kiragu, Mr Kenneth Mungai, Mr Fred Bunde, Mr Edwin Mutuuri, a Mr George and the Attorney-General as defendants.
