PNU faults ruling against Uhuru and Muthaura

The Party of National Unity alliance has expressed its dissatisfaction with the ruling of the ICC on the six Kenyans suspected to bear the greatest responsibility for the 2007/08 post-elections chaos.

The alliance said the ruling was contradictory and maintained that the evidence used by the prosecution fell below the threshold set by the Rome Statute.

The alliance’s convener, Mr Kiraitu Murungi, particularly questioned the logic used to confirm charges against Civil Service boss Francis Muthaura.

Issuing explicit orders

Chief ICC prosecutor Louis Moreno Ocampo had accused Mr Muthaura of issuing explicit orders to Police Commissioner Ali Hussein (also a suspect) directing him not to interfere with the outlawed sect, Mungiki.

Mr Murungi said the ruling was a “surprise” and asked on what basis the court had confirmed the charges against the Mr Muthaura and failed to confirm the charges against the Mr Ali, “the person he is supposed to have instructed.”

“Therefore on what basis did the court find Muthaura on the wrong having released the person he’s supposed to have instructed?” he said.

Mr Murungi said Mr Kenyatta and Mr Muthaura would not resign from the Cabinet.

Vice-President Kalonzo Musyoka described the court’s ruling as “saddening”.
