Major contracts on hold until new government formed

Ministries have been directed to suspend all major contracts until a new government is formed.

New appointments, dismissal of State or public officers during the transition period have also been put on hold.

Head of Public Service Francis Kimemia Tuesday directed all permanent secretaries to suspend all major contracts and payments in excess of Sh500, 000.

The Office of the President further directed any accounting officer seeking to pay contracts that exceed the stated amount to first consult with OP on behalf of the Ministry or parastatals concerned.

“Any exemption to this particular directive must be sought from the Office of the President by the accounting officer on behalf of the ministry or the state corporation concerned,” said Mr Kimemia.

He further declared any appointments made after March 4 were illegal.

In a letter to PSs and accounting officers, Mr Kimemia said those appointed after March 4 should be notified accordingly that their appointments are illegal.

“Article 134 (2) of the constitution forbidding the nomination, the appointment or dismissal of state or public officers is referred to as ‘period of temporary incumbency,” said Mr Kimemia in his letter.

Last month, the government suspend contracts but did not state the maximum amount.

Normal contracting is expected to resume when a new government is in place.
