Contractor now rains on KenGen bond party

Man Diesel also noted that the fact that the evaluation process was not completed within 30 days after the tender documents were opened on August 21, 2009 contravening the procurement law. All these, the firm says, gave KenGen room to manipulate the tender process to lock it out. In their appeal to the review board, Man Diesel wants the decision to award the tender to Wartsila Bv nullified.
But KenGen says its decision was based on a report filed by the independent evaluator and its own engineers with an opinion that Man Diesel tender was substantially non-complaint and recommended that its tender be not considered further. That was after technical evaluation, which is the first stage of the process.
