Teachers accused of defiling nine-year-old girl out on Sh1mn bond

Two teachers accused of defiling a Standard Four pupil have been released on Sh1milion bond with two sureties of similar amount or Sh500, 000 cash bail each.

Isiolo chief magistrate Samuel Muigai yesterday released Paul Murithi Njeru, 24, and Nicholas Mwirigi Mithika, 26.

The Little Angel Academy teachers have been in remand for eight days after they denied the charge.

The teachers took plea before Isiolo Resident Magistrate Joan Irura but the prosecution led by Senior Principal Prosecution counsel Jalson Makori, vehemently opposed them getting bail.

Mr Makori told the court to remand them for seven days for police to complete investigations.

When they appeared before the magistrate, the court room was fully packed by parents, teachers and pupils who keenly followed the proceedings.

The prosecution said it might prefer more charges to the teachers.

Mr Makori in his applications also said that if the teachers were released, they will interfere with the prosecution witnesses most of whom are pupils they teach.

He added there was a public outcry when the teachers were arrested and the emotions from the members of the public was still high and freeing the accused could compromise their security.

Prosecution counsel Isaac Wasike filed the same application but the court ruled in the favour of defence Lawyer Kiogora Mugambi, since there was no sworn affidavit by the investigating officer to compel the court that investigations were still underway.

The teachers were charged that on diverse dates between July 2 and July 21 at Little Angel primary school they defiled a girl aged nine.

They also faced an alternative count, each for practicing an indecent act with a child.

On the second count they were charged with drugging the pupil before they repeatedly defile her.

They were accused of intentionally causing concoction to be inhaled by the minor, stupefying her so as to enable them to engage in sexual activities with her.

Their case will be heard on October 5 and 6.
