The family of tycoon Shahid Pervez Butt are fighting for the control of his wealth a few months after the businessman was shot dead.

Mrs Regine Butt, his second wife has moved to court claiming that Mr Butt’s son, Haroon, and his mother, have demanded that she vacates the family home along Mkomani Road, Mombasa. But Mr Haroon Butt says he is only trying to ensure everyone gets their rightful share of his father’s property.

Regine Butt claims that Mr Haroon stated that he wants to live with his biological mother Akhtar Butt, who is the second respondent in the case.

The businessman was shot dead on July 11 in Changamwe.

According to the application filed under certificate of urgency by Regine, Ms Akhar, who was the first wife of Mr Butt, had separated with their husband and was living in a separate residence.

DEATH OF THEIR FATHER

Regine said she was married to Mr Butt in 2009 and have two children whom they lived with in the family home.

She claims Mr Haroon and Ms Akhar have denied her and her children access to the family home and that her clothes and those of the children and books are in the house.

“Her children are so traumatised and continue to be psychologically tortured; hardly two months into the death of their father,” reads part of the application.

Regine Butt claims that the defendants have taken charge of the family businesses and finances and have denied her and children access to the income.

She is seeking an order restraining the defendants, their servants, employees or agents from dealing, entering or interfering with the plaintiffs’ rights and interests pending inter parte hearing of the application.

In his replying affidavit, Mr Haroon Butt said he is aware of the subject property, which is a commercial residential house belonging to Blue Bell Properties limited.

He is also aware that his father and mother never divorced and that their marriage was never dissolved.

UNJUST AND LESS CANDID

“It is clear that my stepmother is being unjust and less candid with the truth in alleging the subject premises constitute her exclusive matrimonial home and seek to evict us,” Mr Haroon Butt said .

Hearing of the case will resume next Tuesday.
