Man says neighbours demolished houses, leaving family homeless

What you need to know:

  • The farmer from Kyamatu location in Mutito Constituency now wants the National Land Commission to intervene and quash the ruling and orders issued by the administrator so that a court can hear the dispute afresh.
  • The rivals, who were the complainants, raided Mr Kula’s homestead on August 1, demolished all the grass-thatched houses and fenced off the land, effectively rendering the family homeless.

Members of a family are crying for justice after neighbours demolished their houses in a land dispute.

Mr Muthoka Kula was evicted from his ancestral home last month, a day after an administrator ruled in favour of his rivals.

The rivals, who were the complainants, raided Mr Kula’s homestead on August 1, demolished all the grass-thatched houses and fenced off the land, effectively rendering the family homeless.

The farmer from Kyamatu location in Mutito Constituency now wants the National Land Commission to intervene and quash the ruling and orders issued by the administrator so that a court can hear the dispute afresh.

He claims that he was rendered homeless in a non-judicial process, “presided over by a kangaroo court, resulting in gross violation of my rights to a fair hearing”.

LAW AND ORDER

Mr Kula told the Nation outside Kitui Police Station where he had lodged his complaint: “It’s unfortunate that the authorities who should maintain law and order, presided over a dubious case to rob me of the only piece of land that I inherited from my late father.”

Family lawyer Alphonse Kilonzi said he would start criminal charges against those behind the demolition.
