Appeal court to decide governor’s fate Friday

Migori governor Okoth Obado and Nyando MP Fred Outa will on Friday know if they will stay in office when the Court of Appeal decides on cases challenging their elections.

Prof Edward Oyugi of ODM challenged the governor’s election at the High Court but lost the case. He appealed at the higher court.

Mr Obado is the only non-ODM governor in Nyanza.

Prof Oyugi’s first attempt failed last year when Lady Justice Esther Maina ruled that despite the electoral commission’s mistakes, there were no sufficient reasons to nullify the election.

Issues that the Appeal Court will be looking at include whether the judge properly analysed the results of a recount it ordered, which had produced a gap of 577 votes between the Mr Obado and Prof Oyugi instead of 163 according to results announced by the electoral commission.

Prof Oyugi insists that he won the election by 174 votes.

The case against Mr Outa was filed by Mr Jared Okello, who lost by 713 votes. He appealed after the High Court dismissed his petition.
