Three KCSE candidates in court for exam cheating

Three Kenya Certificate of Secondary Education candidates from Nkubu High School, Meru County, have been charged in court with unauthorized possession of examination information.

The three, Abdishakur Hussein, Alex Kaba and Martin Kiruja, all aged 17, appeared before Nkubu Resident Magistrate N.M. Idagwa and denied the charges.

According to charge sheets, the three students, jointly with others not in court, were found in possession of examination information in their mobile phones on October 27.

The charge states that they were found with the unauthorized examination information in the examination centre contrary to Section 27 (i) of the Kenya National Examination Council (KNEC) Act No 29 of 2012.

All the suspects denied the charges and were each given a bond of Sh50,000 and surety of a similar amount or a cash bail of Sh10,000 each.

Ms Idagwa directed that the case to be heard on March 5, 2015.

TEN YEARS IMPRISONMENT

Section 27 (1) of the KNEC Act No 29 of 2012 states that a person who, before or during an examination, has in his or her possession or under his or her control any examination paper or any part thereof, or any material or information purporting to relate to the contents of any paper or material for that examination, without lawful excuse, commits an offence and is liable, upon conviction, to imprisonment for a term not exceeding ten years, or a fine not exceeding two million shillings, or to both.

Meanwhile, a KCSE candidate from Mutunguru Day Secondary School in Igoji West, Meru County, has been sitting for his examination in police custody after he was charged in court for defiling a 14-year-old girl.

Mr Kelvin Murimi Murungi, 18, was arraigned in a Nkubu court before Resident Magistrate N.M. Idagwa and charged with defilement, contrary to section 8 (i) (3) of the Sexual Offences Act No 3 of 2006.

The Form Four student is accused that on November 2, 2014 at Mutunguru sub-location, Igoji West, he intentionally defiled the child.

Murimi denied the charges and is currently remanded at the Nkubu Police Station, where he is doing his remaining KCSE papers.

The suspect appeared in court on Thursday for mention of the case.
