Busia Senator and former Attorney-General Amos Wako has called for the disbandment of the Supreme Court saying it has failed the integrity test.

This follows allegations of bribery against Justice Philip Tunoi in a case involving Nairobi Governor Evans Kidero in an election petition.

Both Dr Kidero and the judge have described the allegations as lies driven by malice.

The Judicial Service Commission has already asked President Uhuru Kenyatta to form a tribunal to investigate the claims against the judge, filed in an affidavit by former Kass FM journalist Geoffrey Kiplagat that he facilitated payment of the bribe to the judge.

Mr Wako said as one of the experts who drafted the 2010 Constitution which created the Supreme Court, he was disappointed that the institution had performed below bar.

According to the former AG, the seven-judge court was supposed to serve as the moral and intellectual compass of the Judiciary.

“I am disappointed that they have failed on the issue of integrity and therefore that affects the entire Judiciary.

“We have to find a way of returning the Supreme Court on track and [for it] to live up to the ideals which we envisaged when drafting the Constitution,” he said.

The senator was speaking in a Busia hotel after meeting with newly-elected ODM officials in the county.

Flanked by Matayos MP Godfrey Odanga, Mr Wako called on youths to obtain ID cards and register as voters.

“We must remain united as we march towards the 2017 General Elections,” he said.
