The election of Olago Aluoch as the Kisumu West MP has been upheld by the High Court in Kisumu.

Mr Aluoch's election had been challenged by Rosa Buyu, who moved to court on April 10 seeking a recount of votes and the nullification of the election.

Kisumu resident judge Hillary Chemitei dismissed Ms Buyu's petition on grounds that even though there were some anomalies, they were not enough to affect the outcome of the election.

Ms Buyu, who vied on an ODM ticket, will also bear the costs incurred by the Independent Electoral and Boundaries Commission (IEBC) and Mr Aluoch in the suit.

Mr Aluoch defected to Ford Kenya after Ms Buyu was given the ODM ticket in January.
