Ballot papers land three in court

Three people appeared before a Machakos court Thursday to face charges of being in possession of ballot papers.

The suspects, Ms Cecilia Kimeu, Mr Boniface Nzyoka and Mr Stephen Omondi were allegedly found with ballot papers in Athi River.

They appeared before Machakos Senior Resident Magistrate Kipkurui Kibellion but did not take plea as the magistrate assigned to hear election maters was away.

The case will be mentioned on Friday.

Meanwhile, the Independent Electoral and Boundaries Commission is expected to present all election materials used in Machakos gubernatorial elections in court on Friday, according to an order given by Justice Aggrey Muchelule last week.

Justice Muchelule is handling a petition filed by Ms Wavinya Ndeti challenging the election of Governor Alfred Mutua.

Dr Mutua was declared winner in the August 8 general elections with 249,954 votes against Ms Ndeti's 209,233 votes.

Ms Ndeti is represented by a team of 10 advocates including Senior Counsel James Orengo and lawyer Daniel Maanzo.

The petitioner wants the court to nullify Dr Mutua's win citing irregularities in the election process.

The case will be heard on October 4th this year.
