DPP wants bribery case against senior officer moved from Meru court

The Director of Public Prosecutions (DPP) wants a case in which a senior police officer is charged with bribery to be moved from a court in Meru to Murang’a.

Prosecutor Antony Musyoka on Tuesday filed an application seeking the transfer of the case against former Tigania West Criminal Investigations Officer James Oludhe Ochieng.

The application was filed before Meru Principal Magistrate Stella Abuya on behalf of DPP Keriako Tobiko.

Mr Musyoka did not explain why the DPP wants the matter transferred to Murang’a while the officer is alleged to have committed the offence in Meru.

The prosecutor told the court he received a letter from the DPP seeking the transfer of the case.

Mr Ochieng, who has been interdicted, opposed the application, calling it a miscarriage of justice as he has been appearing in court since last year.

He noted that the prosecution has sought the adjournment of the case 10 times since he pleaded to the charge.

His lawyer, Wahome Gikonyo, said it is unconstitutional for the DPP to seek the transfer without a valid reason.

The magistrate will rule on the application on September 27.

Mr Ochieng is out on Sh50,000 bail.
