Duale tells CJ Willy Mutunga to resign for ‘condoning graft’ in the Judiciary

National Assembly Majority Leader Aden Duale has asked Chief Justice Willy Mutunga to resign for what he termed as "condoning corruption in the Judiciary."

Mr Duale, who spoke in Nkubu, Meru County on Saturday, said the Judiciary was riddled with corruption and accused the Dr Mutunga of doing little to stop it.

The Garissa Township MP said the bribery claims against Supreme Court Judge Philip Tunoi were a clear indication of the rot in the highest court in the land.

“You continue embezzling public funds and you have turned the temple of justice to the temple of corruption.

“But we will wait for the final decision of the tribunal set up to investigate the corruption claims against Judge Tunoi,” he said.

Mr Duale called for a proper inquest into the bribery claims after the Judicial Service Commission Friday announced that there was satisfactory evidence of the judge’s misconduct.

The JSC has recommended that the President appoints a tribunal to investigate the claims against Justice Tunoi.

On his part, Chuka/Igambang’ombe MP Muthomi Njuki wants Nairobi Governor Evans Kidero further probed following claims that he bribed the judge in an election petition.

“It takes two to tango. If Judge Tunoi is found culpable, then Dr Kidero should also be probed. There is no way the judge could have been bribed by nobody,” he said.

Mr Njuki said if indeed money was given to influence the outcome of the case, then other judges who constituted the bench were likely to have been bribed.

The two spoke at a fundraiser for the South Imenti Mashinani Youth Empowerment Sacco where Deputy President William Ruto was the chief guest.

Justice Tunoi has denied that he received Sh202 million to decide the petition case in favour of Dr Kidero.

The judge attributed the corruption allegations against him to the jostling for succession in the Supreme Court.
