Meru court jails for life man who defiled a 9-year-old girl

A man has been sentenced to serve life in jail for defiling a nine-year-old girl.

Dennis Mutwiri, who hails from Mitunguu in Meru County, was Thursday convicted by Nkubu Principal Magistrate Duke Ocharo.

Mr Ocharo said the court was convinced by the prosecution witnesses’ evidence against the accused.

The magistrate added that the prosecution proved the case beyond any reasonable doubt and the accused deserved a life sentence for committing the heinous act to a minor.

The minor was admitted to hospital for a month after the ordeal.

“The court heard from the first witness that the accused dragged the victim from the road, took her to his bed and had sex with the child after undressing her.

“The child, who was the first to give evidence in court, said that she knew the accused very well and she screamed when he was defiling her in his house but no one came to her rescue,” said the magistrate.

BLEEDING PROFUSELY

The court also heard that after the girl was defiled, her mother and her elder sister realised she was bleeding profusely from her private parts and rushed her to hospital for treatment.

The minor was taken to Mitunguu Health Centre before being transferred to Kanyakine Level IV Hospital for treatment.

“The child’s mother, who testified in court, said that her child was bleeding and had explained to her what happened.

“The torn pants of the victim that were produced in court as exhibit also had blood spots. This showed that, indeed, the girl was defiled,” said Mr Ocharo.

The magistrate also noted that a doctor’s report and the evidence he gave in court indicated that the minor had been defiled.

“From the evidence given by the prosecution witnesses, I am convinced that the accused indeed defiled the victim who at the time was nine years old.

“I hereby convict him accordingly and as stipulated by the law concerning rape and defilement offences,” added Mr Ocharo.

On mitigation, Mutwiri pleaded with the magistrate for leniency saying his three children were suffering as he had been in remand for three years.
