'I am suffering in prison,' MP's son tells Mombasa court

Matuga MP Hassan Mwanyoha‘s son who is serving a death sentence for robbing a tourist, on Monday narrated to a Mombasa court his suffering at the Manyani Maximum Prison.

Mr Mafanikio Mwanyoha alias Fani Hussein told Mombasa High court Judge Justice Dorah Chepkwonyi that life has been unbearable since being sentenced to death in April this year.

“Your honour, I am suffering in prison, life there is harsh and I find it unbearable, I need your help ” he said.

The younger Mwanyoha asked the High Court to serve him with proceedings of his case to enable him appeal against it.

Mr Mwanyoha who almost broke down to tears pleaded with the judge to recall his file from Kwale Court where he was sentenced.

But Ms Chepkwonyi told him that the proceedings of his case had not been typed and hence could not be availed to him.

“I am willing to help you but the problem is that the proceedings of your case has not been typed,” she said.

Mr Mwanyoha said he intends to appeal against the judgement by a Kwale magistrate that had handed him death sentence after he was found guilty of committing the offence on August 19, last year, at Bougan Villa Estate in Diani.

ARMED WITH A KNIFE

He was accused of robbing Mr Peter Schadwsky of a bag, an LG mobile phone, a pair of spectacles, a company ID and five credit cards valued at Sh14,625 while armed with a knife, the court had been told.

Mr Mafanikio is also facing another robbery with violence case at the Mombasa High Court. The case will be mentioned in September 21.

In another court, police have been given 10 days to detain a man suspected to be a member of Al-Shabaab terrorist group.

Principal magistrate Francis Kyambia allowed the police to detain Mr Mohammed Suleiman Swaleh at Nyali police station to enable them complete investigating him.

Prosecution told the court that some of the items seized from the suspect such as mobile phones and compact discs have been taken to Nairobi for forensic analysis.

The suspect was arrested on September 3 at Mshomoroni in Mombasa County by Anti-Terror Police Unit who had been tipped by the public.

The suspect is said to have links to the militia group and has information that can assist police trace more terror suspects.

The court heard that the suspect is an Al-Shabaab operative working on the ground to recruit youth to join the militia group in Mshomoroni and its environs.

State Counsel Wangari Mwaura told the court that investigations into the matter is wide and complex hence needed more time to complete.

The case will be mentioned on September 15.
