Doctor to treat man on ivory charge at Shimo la Tewa Prison

A Mombasa businessman facing a charge of being in possession of 2,152 kilogrammes of ivory will be allowed to see his personal doctor at the Shimo la Tewa Prison where he is being held.

Mombasa Senior Resident Magistrate Ben Ekhubi directed that Mr Feisal Mohamed Ali alias Feisal Shahbal’s doctor be allowed at the prison clinic.

Through his lawyer, Mr Michael Oloo, the accused had told the court that he was seriously ill.

Mr Oloo said it has not been possible to treat the accused in prison and he should be allowed to seek treatment at the Coast Provincial General Hospital.

Assistant Director of Public Prosecutions Alexander Muteti said he had no problem having the accused seen by his doctor but was apprehensive about his admission to the hospital.

“The last thing to do is to risk the security of the accused,” said Mr Muteti.

He added that the accused be taken to hospital and that if he is not well, a medical report be presented in court.

The accused was to renew his application for bond Monday but the trial magistrate was not present.

The accused is also facing another charge of dealing with the tusks without a licence.

He denied all the charges when he first presented to court and the prosecution opposed his release on bond.

Prior to being charged, there was a warrant of arrest in force against him.

He has been charged alongside Mr Abdul Halim Sadiq, Ghalib Sadiq Kara, Praverz NoorMohamed and Mr Abdulmajeed Ibrahim.

The offence is alleged to have been committed on June 5, 2014 at the business premises of Fuji Motors East Africa Limited situated along Tom Mboya Avenue, Tudor Estate Mombasa.

The case will be mentioned on Friday.
