Man gets life sentence for defiling daughter

A man who defiled his six- year old step-daughter has been jailed for life by a Nakuru court.

Nakuru Resident Magistrate Judicaster Nthuku who delivered the judgment said the prosecution had proved that the accused committed the heinous act.

Mr Anthony Kyalo Mutemila, a father of five and married to two wives is said to have defiled the minor on the night of July 16, 2015 at Nakuru’s Rhonda Estate in the presence of the girl’s mother.

His second wife who is also the biological mother of the minor, in her testimony in court said she was shocked that the man she called her husband forced the daughter to offer him conjugal rights ‘like she-the mother- used to’. She recommended that he be punished for the inhuman act.

In her judgment the Magistrate said: “A man who defiles his daughter and takes away her innocence leaves lifelong scars in the life of the child. Such people do not deserve leniency.”

The Magistrate said witnesses who testified in court had proved beyond reasonable doubt that the accused committed the offence.

Others who testified include the minor, a neighbour, a doctor and a police officer.

The minor in her testimony told the court that on the fateful night, her father defiled her on a couch where she used to sleep and only stopped after her mother screamed attracting the attention of neighbours.

The minor told the court she knew the man who defiled her as her father.

She also told the court that it was not the first time the ‘father’ had defiled her, revealing that he had done so severally on his matrimonial bed while her mother was away at work.

The mother gave a detailed testimony to court on how she caught her husband committing the act to their daughter whom she said is not his biological child.

"My husband gave me Sh30 and sent me to go and buy a bottle of soda but it was late and I declined. He went and bought the soda himself. When he returned he ordered me to switch off the lights,” she narrated in court.

"I was shocked to realize he was not in bed with me minutes later when I stretched my hand to reach him. I hurriedly switched on the lights and caught my husband in the act,” she added.

The woman informed neighbors and the police leading to the arrest of the accused.

The mother also disclosed in court that she had been married to the accused for four years.

A doctor from the Rift Valley Hospital who examined the child confirmed that the minor was defiled.

But in defence, the man claimed his daughter and mother were pathological liars and pleaded with the court to be lenient on him.

However magistrate Nthuku said that the sentence was reasonable in relation to the offence committed.

The accused was given a 14 days to appeal.
