Ex-policeman in Narok robbery case sentenced to death

A Narok court has sentenced a former police officer to death after he was found guilty of robbery with violence.

Lawrence Gathuka, who was attached to the Anti-Stock Theft Unit headquarters in Gilgil, was also found with an armed pistol that had been reported missing.

“The evidence is strong enough to convict you since all witnesses were clear that it was you who had the pistol.

“The police spared your life and to deter such incidents in future, I have no option but to sentence you to death,” Senior Resident Magistrate Allan Sitati said.

The firearm was later discovered to have been stolen from Mr Stephen Ole Koriata, a businessman in Narok.

CORNERED HIM

According to Kericho Police boss Abdi Rahaman, the accused surrendered when the pistol jammed as he tried to fire at officers who cornered him trying to rob a Kericho wholesale shop.

His four accomplices were killed and a woman driver seriously wounded during the incident at Enegut area.

The court was told how the businessman was robbed of his Ceska pistol, a cell phone and Sh65,000 at Masaa -Ndare village in Narok South Sub-County on September 5, 2010.

Mr Matia ole Nchoko was also robbed off Sh 84,000. Githuka however denied committing the offence.

On Monday, the magistrate noted that Githuka had betrayed the trust of Kenyans bestowed on him to safeguard lives and there was proof beyond any reasonable doubt that he committed the offence.

An alibi presented by the accused that he was on sick leave attending his sister’s fundraising ceremony in Ngong was also rejected.
