Fake lawyer’s bond cancelled, to remain in custody until case is determined

  • Senior prosecution lawyer Allan Wanjohi had written to the High Court seeking to have Mr Macharia detained because he had been on the run when he was arrested.
  • Mr Macharia was arrested by Directorate of Criminal Officers at Narumoru town in Nyeri County who had been sent from Nairobi following a LSK complaint.

A man arrested and taken to court for purporting to be a lawyer will remain in police custody until his case is determined.

Justice John Mativo on Tuesday set aside orders issued by resident magistrate John Aringo allowing Mr Washington Munene Macharia to be released on a Sh100, 000 bond and reinstated orders earlier issued by resident magistrate Ruth Kefa.

Justice Mativo said the reasons which lead to his release are not justified and ordered that he be detained.

Senior prosecution counsel Allan Wanjohi had written to the High Court seeking to have Mr Macharia detained because he had been on the run when he was arrested.

Mr Macharia was arrested by Directorate of Criminal Officers at Narumoru town in Nyeri County who had been sent from Nairobi following a Law Society of Kenya complaint.

He was charged on July 12 with pretending to be an advocate.

The court heard that prior to his capture, Karatina Law Courts and Kangema Law Courts had issued warrants of arrest against him.

Mr Wanjohi said, if the accused person is released on bond by the court, there are high chances he would disappear as he has done before.
