Central Organisation of Trade Union (Cotu) Deputy Secretary-General George Muchai has sued his boss, Francis Atwoli, seeking orders to prevent Cotu from discussing his conduct.

Mr Muchai, who is also the Kabete MP, claimed that Mr Atwoli called a board meeting on October 6 at Lake Bogoria Spa Resort where they made a myriad of sensational and malicious allegations regarding his conduct.

He said as a result, they purported to remove him as deputy secretary-general.

He said that the bad blood that exists between him and Mr Atwoli arose from the sale of Cotu property in Mombasa.

Mr Muchai said he had been summoned in 2007 to record a statement at the CID headquarters over the sale of a Mombasa property by Mr Atwoli.

As a result of the sale, Labour Cabinet Secretary Samuel Kambi wrote a letter dated April 17, 2014, requiring the trustee of Cotu to explain the sale of property and payment of Sh4.2 million to Toyota Kenya in October for the purchase of a vehicle for Tom Moya Labour College in Kisumu.

Muchai said he declined the police request, saying he was not a signatory to the Cotu bank account.

He said when he told Mr Atwoli about the matter, the Cotu boss summoned him and showed him a statement recorded with police on the issue but he declined to adopt it.

The case was placed before Justice David Onyancha, who certified it urgent and ordered lawyer John Khaminwa to serve the suit papers on Mr Atwoli and Cotu chairman Mr Rajab Mwondi to come for an inter partes hearing on October 29.
