Cotu wants private suit against ex-NSSF officials

The Central Organisation of Trade Unions (Cotu) wants to be allowed private prosecution against senior officials of the National Social Security Fund (NSSF) over the loss of Sh5 billion.

The trade union, through lawyer Samuel Aduda, claimed they have sufficient evident to prosecute suspended NSSF Managing Trustee Richard Langat, Adan Daud Mohamed, Ali Ismail Noor, Mutua Kilaka, Mutemi Nzetu and Gideon Kyengo with abuse of office in managing NSSF funds.

“Cotu has supplied evidence to several State agencies but they have refused to take action against the individuals.

“Workers money has been corruptly used in Tassia II upgrade project, with Sh5.03 billion being committed to contracts in very dubious and illegal circumstances,” said Mr Aduda.

ABUSE OF OFFICE

Cotu has drawn a charge sheet, which, if accepted by the court, will see Mr Langat and his colleagues charged with three counts of abuse of office.

According to the umbrella workers union, Mr Langat abused his functions by unlawfully preparing, procuring and authorising the expenditure of Sh5.03 billion in the Tassia II infrastructure upgrade project with the intent of conferring a benefit upon himself.

Cotu accused the Ethics and Anti-Corruption Commission and the Director of Public Prosecutions of sitting on the fence when workers’ money was being misused, adding that their quest for private prosecution is the only way to safeguard the funds and bring the suspects to book.
