Trader wants lawyer out of Evans Kidero case

A second attempt has been made to remove lawyer Ahmednasir Abdullahi from representing Kakamega Senator Boni Khalwale in a case in which the latter has been sued by Nairobi Governor Evans Kidero.

Businessman Bryan Yongo wants to be enjoined in the case so that he could show that Mr Ahmednasir was not qualified to act as an advocate, having undertaken his pupillage under an advocate who did not hold a practising certificate.

“The actions of the advocate amount to contempt of court,” said Mr Yongo.

PLAY ROLE OF COUNSEL

Mr Kidero, through lawyer Tom Ojienda, urged the court to stop Mr Ahmednasir from handling the case because he is likely to be summoned to be a witness.

Prof Ojienda said that Mr Ahmednasir was sitting as an arbitrator in a dispute between Mumias Sugar Company and the Mumias Outgrowers Company and cannot play the role of counsel.

Dr Kidero sued over remarks he claims Dr Khalwale made in Mumias linking him to the mismanagement of the sugar firm.

Dr Khalwale has denied ever misrepresenting facts.

The hearing starts on Thursday.
