Brothers want sister-in-law locked out of estate

Two brothers have opposed their sister-in-law’s bid to inherit the estate of her late husband for whose murder 12 years ago she is being tried in court.

The Sh700 million estate comprises half an hectare of land at Lower Kabete and a house each in Lower Kabete and Brookside Gardens, as well as an apartment in Nyali Estate, Mombasa.

There is also Kenya Airways shares; Mt Kenya Sundries, a retail shop at the Nairobi Hilton; Maya duty-free shops at JKIA; Sapra Investment Ltd; and Green Gems Ltd.

'MALICIOUS'

Mr Kuldip Madan Sapra and Mr Ashman Madan Sapra have opposed their prosecution for allegedly attempting to acquire the estate of their late brother.

The late Yogash Madan Mohan Sapra was allegedly killed by his widow, Dr Nisha Rajendhra Kumar Pruthi, a dentist, in August 2005.

Defence lawyers Harun Ndubi and Kwame Nkurumah urged Nairobi Chief Magistrate Francis Andayi to dismiss the brothers’ case as it was instigated maliciously by the Director of Public Prosecutions (DPP) to defeat the succession case before Justice Aggrey Muchelule.

“For the past five years, Dr Sapra has not responded to the succession case, where Madan and another have been given a limited grant to administer all the estate they jointly own with their late brother,” Mr Nkurumah told Mr Andayi on Monday, saying they have an equal share.

They said a murder or manslaughter suspect cannot inherit the estate of the person they are accused of killing.

State prosecutor Solomon Naulikha and Dr Sapra’s lawyer Justus Areba will respond to the case on January 22.
