JSC stopped from shortlisting judge for Chief Justice post

The High Court in Nairobi has declined to compel the Judicial Service Commission (JSC) to shortlist a judge for the position of Chief Justice.

In her ruling, High Court judge Roselyne Aburili said Justice GBM Kariuki had not applied for the vacant position formerly held by Dr Willy Mutunga.

The judge also declined to compel the Directorate of Criminal Investigations (DCI) to issue Justice Kariuki with a certificate of good conduct.

Justice Kariuki had sued the DCI and the Inspector General of Police for delaying to issue him with certificate of good conduct saying it was a calculated move to curtail him from vying for the vacant CJ post.

Judge Aburili, however, termed it an afterthought.
