Kidero ordered not to sack Nairobi County Transport Executive

The High Court has ordered Nairobi Governor Evans Kidero not to sack County Transport Executive Evans Ondieki if Members of County Assembly resolve to remove him from office on Tuesday.

The Nairobi County Assembly is expected to sit Tuesday to make a final resolution on whether to impeach Mr Ondieki.

Justice Isaac Lenaola directed Mr Kidero not to dismiss the Transport Executive ‘even if the County Assembly makes any resolution concerning him’ until the case is heard on May 16, 2014.

The move to impeach Mr Ondieki was challenged in court by Mr Okiya Omtata and Wycliff Gisebe. Mr Ondieki is an interested party in the suit.

They have sued the Speaker of the Assembly, interim clerk, County Assembly and the Ethics and Anti-Corruption Commission

They argued that there was no evidence provided to show Mr Ondieki committed crimes alleged by the MCAs and asked the court to declare the impeachment motion null and void.
