DPP appoints senior prosecutor in Senator Muthama’s case

The Director of Public Prosecutions (DPP) has appointed a senior state counsel to lead two others in an incitement case against Machakos Senator Johnson Muthama.

The DPP appointed Moses Omirera to lead prosecutors Duncun Ondimu and Eddie Kadebe.

The DPP said the move was necessitated by complaint by defence lawyers that they have not been supplied with evidence and witness statements in the last three years.

The defence lawyers are Senior Counsel John Khaminwa and James Orengo.

Mr Omirera sought an adjournment to allow the prosecution supply the defence with the required documents but Dr Khaminwa opposed the move and asked the court to acquit his client.

Mr Ondimu told the court that the prosecution is being frustrated by officers from the National Cohesion and Integrity Commission who investigated the case.

However, the magistrate directed the case to be heard in November 8 and 9

In the case, Mr Muthama is charged alongside activist Japheth Muroko.
