Digital migration to proceed after High Court dismisses petition

The migration from analogue to digital television broadcasting will continue as planned after the High Court on Monday dismissed a petition filed by three leading media houses seeking to stop the process.

Mr Justice David Majanja ruled that the date for digital migration was set by consensus involving the petitioners and was not arrived at unilaterally, noting that "no date for [analogue] switch off will be perfect, now or in the future".

"I see no reason to step in and forestall the digital migration process," said judge Majanja in his ruling.

Following the ruling, Senior Counsel Paul Muite, representing the media houses, asked for the orders stopping the analogue switch off be extended for 30 days. However, judge Majanja dismissed that application as well.
