Bid to block Evans Kidero suit on media flops

Nairobi Governor Evans Kidero’s case seeking to block reporters from linking him to Mumias Sugar’s financial woes will proceed to a full hearing after the High Court declined to strike it out.

Mr Justice Alfred Mabeya ruled that Dr Kidero’s suit was properly filed before the civil division and that did not justify dismissing it or transferring it to the constitutional division as submitted by two leading media houses.

According to the judge, a party cannot be denied access to justice just because of wrongly drafting a case.

Dr Kidero is seeking to stop Nation Media Group and Standard Group from linking him to troubles facing Mumias Sugar Company and clear his name from any wrongdoing.

Through senior counsel Tom Ojienda, the governor argued that the financial forensic audit by KPMG showing massive losses at the company began after he had left the company and did not cover the years he was at the helm.
