Farmer sues MP over Sh138m loan

A Kajiado farmer has sued Mwingi Central MP Joe Musyimi for using his title deed to obtain a Sh138 million loan from a bank.

Mr Wilson Ankaine Kisemei says that Mr Musyimi forged and created a fraudulent guarantee without his knowledge and took a loan with the title.

Mr Kisemei’s lawyer Mathew Okoth says that his client was surprised to get a letter from the bank telling him his land will be auctioned.

Court documents indicate Mr Kisemei had a lease agreement with Mr Musyimi and his company, Mercbima International Ltd, to run a quarry on his 21-acre farm in Kajiado at a monthly rent of Sh300,000.

After sometime, Mr Musyimi asked Mr Kisemei to give him his original titles allegedly to show a bank the site where his company was quarrying.

“Based on the respect and trust he had for the MP, Mr Kisemei gave him the titles,” said Mr Okoth.

However, Mr Musyimi forged the farmer’s signature and purporting that he was a guarantor for a loan with Equatorial Commercial Bank.

On October 8, Mr Kisemei said he received a letter requiring him to settle a loan he had apparently guaranteed Mr Musyimi and his company.

“They even attempted to create a fraudulent charge over the land without his knowledge,” said Mr Okoth. He said Mr Kisemei has not sought a bank loan or guaranteed the MP for one.

He said Mr Kisemei has received information that the bank has instructed auctioneers to recover the outstanding loan issued to the MP including taking over his land used to guarantee the loan without his knowledge.

He is further accusing the bank of colluding with the MP to accept forged documents.

Justice Samson Okongo set October 28 as the date for an inter-parties hearing.
