Fight over Shollei sacking moves to Industrial court

A petition by former chief registrar of the Judiciary Gladys Shollei challenging her sacking over allegations of misappropriating over Sh2 billion has been referred to the Industrial Court.

Lady Justice Mumbi Ngugi ruled that the issues raised by Mrs Shollei in her dispute with the Judicial Service Commission involved labour relations between an employer and an employee and which are a preserve of the Industrial Court.

“I have gone through the file and the issues raised touch on employer and employee dispute which are within the jurisdiction of the Industrial Court. I thus transfer the matter to that court for directions by the principal judge Tuesday,” directed Judge Ngugi.

Mrs Shollei filed an urgent petition last Friday seeking to quash the JSC decision to send her home.

She is also seeking a declaration that her rights were violated since the allegations raised against her did not exist in any law and wants compensation for the termination of her employment.

The former registrar claimed that JSC violated her rights including the right to fair trial, right to public hearing, presumption of innocence and the right to heard by an impartial tribunal.

“In purporting to sack Mrs Shollei, the JSC exercised powers it did not have since the office of the chief registrar is only accountable to the National Assembly and to the Treasury,” said lawyer Donald Kipkorir representing her.

Kept in the dark

Mrs Shollei swore that the JSC did not inform her of the charges and that the commission never afforded her reasonable time to prepare a response to the allegations.
