Bid to merge police hiring cases rejected

The High Court on Tuesday declined a request by the Attorney-General to merge all cases challenging the recruitment of police officers.

Mr Justice George Odunga refused to allow the request, saying that he did not have the powers to order the cases to be merged since he had not handled any of them.

The judge directed State lawyer Paul Ojwang to instead ask for the transfer of the cases to Nairobi so that a judge who has handled those cases can decide whether to merge or hear them separately.

“The cases filed in various courts countrywide arise from the same cause of action and there is a likelihood that the courts may arrive at varying decisions unless there is consolidation of the same,” argued Mr Ojwang.

He had earlier stopped the admission of the 10,000 recruits until a report detailing how the recruitment was conducted was tabled by the National Police Service Commission.

The AG had initially objected to the temporary orders issued, saying the move would punish innocent Kenyans.

According to the AG, the cases were overtaken by events.
