High Court halts development on Sh8bn Karen land

A High Court judge has ordered the Lang'ata police boss to stop development on a 134-acre plot in Karen valued at Sh8 billion and whose ownership is contested by two businessmen.

Those to be affected by the court's order are at least 40 Members of Parliament and top Jubilee government officials believed to have benefited from the prime property.

They have gone ahead to prepare basic infrastructure in flagrant disregard of a High Court order stopping development on the land.

Justice Lucy Nyambura Gacheru on Monday ordered the Lang'ata OCPD to ensure compliance with a court order issued on September 3 that stopped three companies from interfering with the said land following an application by Muchanga Investment, owned by businessman Horatius Da Gama Rose.

At the centre of the dispute is city businessman Da Gama Rose and former National Social Security Fund (NSSF) Managing Trustee Jos Konzolo, the owner of a company called Telesource, which has said it owns the land.

In Monday's proceedings, Justice Gicheru allowed an application by Da Gama Rose's lawyer, Cecil Miller, to enjoin Mr John Mugo Kamau in the case.

Mr Mugo will appear in court to testify on how he acquired the land, which he allegedly sold to Telesource in 2005.

National Land Commission Chairman Muhammad Swazuri on Sunday challenged those who have invaded the 134-acre plot in Karen valued at Sh8 billion to prove their ownership.

Dr Swazuri said according to the commission's records, the private owner of the said land was Da Gama Rose’s company, Muchanga Investments Limited.

“From our records, the owner is none other than Muchanga Investments Limited, so what I am reading from the media is baffling because the commission is not aware that the sub-divisions were done.

"They were done without our approval,” he added.
