A court has revoked a notice appointing a chairperson to the national pension fund board of trustees.

Labour Cabinet Secretary Kazungu Kambi had appointed Ms Charity Kisotu as chairperson of the National Social Security Fund Board of Trustees.

Justice Helen Wasilwa suspended Mr Kambi’s gazette notice appointing Ms Kisotu and Ms Damaris Muhika to the NSSF board over claims that they were done without following due the law.

“Pending hearing and determination of the suit, an order is issued suspending gazette notice 725 of February 6, 2015, for not meeting requirements of the NSSF Act on provisions of appointing members to the board,” said Judge Wasilwa.

ANOTHER BLOW

The order was another blow to Mr Kambi’s attempts to reconstitute the NSSF board after another court order issued on Monday stopped the board from holding any meeting.

The petition against the appointments was filed by Mr Anthony Kinyua, who argued that the minister not only violated the NSSF Act, but also the Constitution, which stops him from appointing a person to hold two public positions.

During the appointment, Ms Kisotu was also a member of the Nairobi City County Service Board.

Mr Kinyua’s lawyer Dennis Mosota argued that Mr Kambi’s decision to appoint Ms Kisotu and Ms Muhika was a violation of a court order that had restrained him from replacing Mr Francis Atwoli of Cotu and Ms Jackline Kamau of Federation of Kenya Employers.

Mr Mosota said the CS had no legal authority to replace the two, since the new NSSF Act gave them a fresh three-year term.

The judge directed Mr Kinyua to serve the CS before the hearing on March 11.
